On January 26, 2017, the Planning Commission approved a parking waiver and outdoor seating with alcohol service in association with a restaurant to be established at 724 Wealthy Street SE and 409 Charles Avenue SE, located at the southwest corner of the intersection of Wealthy Street and Charles Avenue.  Subsequent to the Planning Commission approval, the two properties were combined into a single lot and are now known as 724 Wealthy Street SE.

 

As part of the project, the applicant desired to construct four parking spaces along the southerly lot lineBecause the property is adjacent to a City parking lot to the south, access from the City parking area would be necessaryTraffic Engineering and Mobile GR reviewed the proposal and are amenable to the concept. 

 

In order to clarify that the use of the City property is revocable at any time and that no permanent rights are being conveyed by the use, the City Attorney’s Office recommends that the City enter into a license agreement with the property owner. 

 

The attached resolution provides authorization for the Mayor to sign a license agreement with GAC GR RE, L.L.C. for this purpose.

WHEREAS:

 

1. On January 26, 2017, the Planning Commission granted Special Land Use approval to GAC GR RE, L.L.C. to facilitate the establishment of a restaurant at 724 Wealthy Street SE and 409 Charles Avenue SE; and

 

2. In accordance with the approved site plan, GAC GR RE, L.L.C. desires to add private parking spaces on the property, for which ingress and egress access would occur via property owned by the City; therefore

 

RESOLVED that a license agreement is approved and the Mayor is hereby authorized to execute said agreement with GAC GR RE, L.L.C. for ingress and egress via the city parking lot at 411 Charles Ave. SE and 412 Henry Ave. SE. in a form to be approved by the City Attorney.
