The attached resolution provides for the approval of a Construction Agreement with the City of Kentwood (Kentwood) and PR Woodland Limited Partnership/PR Woodland Anchor-S, LLC (Developer); the approval of two Release of Portion of Easements, and the acceptance of two Public Utilities Easements to facilitate the construction of public sanitary sewer and water main in connection with the above-captioned project. The project is privately funded and involves the expansion of the Woodland Mall retail development in Kentwood.

 

The public sanitary sewer and water main will be maintained by the City of Grand Rapids (Grand Rapids) in accordance with the current customer community service agreement. The Public Utilities Easement gives the City rights to maintain said public utilities. The Release of Portion of Easements are covering sections of public sanitary sewer and water main that are to be removed/abandoned as part of the project.

 

Recommended herein is a Construction Agreement that provides for the construction to be performed in accordance with Grand Rapids’ Standard Construction Specifications 1993 and any revisions thereto, including bond and insurance requirements. Field inspection will be done by Grand Rapids. The public sanitary sewer and water main will be constructed by a contractor prequalified to do such work under contract by the Developer. The City will be reimbursed the cost of services (inspection, plan review, administration, etc.) associated with the project in accordance with the Construction Agreement.

 

This project is located north of 28th Street and west of East Beltline Avenue in the Utility Service District of Kentwood and has been previously approved in concept by staff.

RESOLVED:

 

1. That the aforesaid Construction Agreement be approved and that, upon approval as to form by the City Attorney, the Mayor and City Clerk be authorized to execute said Agreement on behalf of the City; and

 

2. That the aforesaid two Release of Portion of Easements from the following property owners, with description of the aforesaid portion of easements to be released, be approved and that, upon approval as to form by the City Attorney, the Mayor and City Clerk be authorized to execute said Release of Portion of Easements on behalf of the City:

A TWENTY (20) FOOT WIDE PUBLIC UTILITIES EASEMENT LOCATED IN LOT 16 OF THE “PLAT OF WOODLAND MALL”, PART OF THE SOUTHEAST 1/4 OF SECTION 10 AND PART OF THE SOUTHEAST 1/4 OF SECTION 10 AND PART OF THE SOUTHWEST 1/4 OF SECTION 11, TOWN 6 NORTH, RANGE 11 WEST, CITY OF KENTWOOD, KENT COUNTY, MICHIGAN, AS RECORDED IN LIBER 77 OF PLATS, ON PAGE 44, THE CENTERLINE OF SAID EASEMENT BEING DESCRIBED AS FOLLOWS:

COMMENCING AT THE SOUTHEAST CORNER OF SAID LOT 16 THENCE N3°36'50”E, 490.00 FEET ALONG THE LOT LINE COMMON TO SAID LOT 16 AND LOT 17 OF THE “PLAT OF WOODLAND MALL” THENCE N86°23'10”W, 107.10 FEET; THENCE S51°10'20”W, 207.64 FEET ALONG THE APPROXIMATE CENTERLINE OF AN EXISTING 10 FOOT WIDE SANITARY SEWER EASEMENT AS RECORDED IN LIBER 2055, PAGE 732 TO THE POINT OF BEGINNING OF THIS EASEMENT CENTERLINE DESCRIPTION; THENCE CONTINUING S51°10'20”W, 10.00 FEET TO AN EXISTING SANITARY MANHOLE; THENCE S56°23'00”W, 56.00 FEET; THENCE S03°38'00”W 174.50 FEET TO THE POINT OF ENDING, CONTAINING 4810 SQ.FT., MORE OR LESS.

 

4. That the City Clerk is hereby authorized and directed to record the aforesaid Easements with the Kent County Register of Deeds.
